BOARD OF COMMISSIONERS MEETING
May 9, 2006
AGENDA
1. The Board of Commissioners will consider an amendment to the Town’s zoning ordinance, specifically Section 66-45(11). R-1 single family residential district. The recommended amendment is to clarify the number of bedrooms allowed when a lot exceeds 5,000 square feet with a front footage of more than sixty feet. The addition would read:
“ Platted lots containing an area of more than 5000 square feet, with a front footage of more than sixty (60) feet are limited such that the construction of a house thereon shall contain eight (8) or fewer bedrooms.”
2. The Board of Commissioners will hear comments on the new Federal Insurance Program Flood Damage Prevention Ordinance & Maps and modifications to the flood ordinance. It is the responsibility of the Town to adopt regulations designed to promote the public health, safety and general welfare of its citizenry. The new maps will replace those dated April 2, 1991 and will impact upon construction issues and flood insurance rates.
3. The Board of Commissioners will also consider the proposed amendments to Article III of the Subdivision Ordinance that deals with required improvements and minimum standards of design:
A. The deletion of Section 50-92 (a) entitled “Suitability of Land, Corrective measures required that currently applies to the requirement that a developer address dangerous land conditions.
B. In Section 50-94 (b)(1) delete the provision that requires “It is not sufficient merely for the average lot to meet zoning requirements.”
C. In all sections that refer to “Director of Public Works”, the text shall be amended to apply to “Director of Public Utilities.”
D. Section 50-94 Subdivision Design (2)(d) Open space requirement. Recommended change deletes the usuage of the term “open” and replaces the term with “residential green” throughout the subsection.
E. Section 50-95(a)(1) entitled “Type of streets required” to provide for the deletion of certain sentences and the addition of other sentences so that the section reads as follows: “All subdivision lots shall abut on a public or private street. All new subdivision streets created pursuant to this chapter shall be constructed so that they qualify for acceptance either by the Town or the NCDOT, and shall be offered for dedication to the Town or NCDOT upon completion. A written maintenance agreement with provisions for maintenance of the street until it is put on the state system shall be included with the final plat.”
F. Section 50-95(e)(1) entitled “Right-of-way widths” to replace “state department of transportation” with “NCDOT” and the addition of language so that the section reads: “a. In the extraterritorial area of the Town, all streets except those in planned unit developments, shall be public rights-of-way and shall conform to NCDOT standards, or the standards of this chapter, whichever are stricter.”
G. Section 50-95(e)(1) entitled “Right-of-way widths” shall provide “Inside the corporate limits all new streets shall have a minimum ROW of 60 feet for two way traffic and 30 feet for one way traffic. Cul-de-sac street turnarounds shall have a minimum 50 foot turn radius.”
H. The elimination of a provision for collector streets in Section 50-95(e)(1)(c) and 50-95(e)(2)(c).
I. A requirement that for all new streets, the minimum pavement width shall be 20 feet for two way and 12 feet for one way traffic and that streets that are to be accepted into the NCDOT system must comply with the NCDOT standards.
J. A requirement with regard to sidewalks that will read “Sidewalks shall be required by the Board of Commissioners on both sides of the street in areas likely to be subject to heavy pedestrian traffic. Such sidewalks shall be constructed to NCDOT standards. All sidewalks shall be placed in the right-of-way unless the sidewalk is part of the residential green space provision as required by these regulations.”
K. Technical modifications to the provisions regarding street names to address the Brunswick County 911 system and placing final decisions with the “Board of Commissioners.”
L. Modifications to the utilities section that designates the title of various staff, a requirement for surface drainage systems to comply with the Town’s stormwater management ordinance, DOT stormwater rules, and requiring a design registered engineer to certify the plans and specifications, eliminates construction procedures and renumbers certain sections due to the elimination of same.
