BOARD OF COMMISSIONERS MEETING

April 10, 2007

AGENDA

 

8: 00 a.m.  A Public Hearing shall be held to hear public comment concerning 

                   modifications to the Town’s Zoning Ordinances as follows: 

 

  1. To modify Article XI Board of Adjustment Section 66-403 to add a subsection that shall provide for the method by which hearings are continued and to allow for testimony to be taken if individuals are present for a hearing and cannot return to the continued session. A hearing continued upon the motion of the petitioner shall be continued in open session to a day certain and newspaper publication shall not be required, however certified letters once mailed shall be mailed again and the petitioner shall have the obligation to pay for said mailings.
  2. To modify Section 66-281 entitled "Supplementary Regulations" to add and or delete the following:

Add first paragraph to read:  Due to the specific nature of certain uses that require a more concise explanation of district regulations as they apply to each instance, the following supplemental regulations are established.

Amend item (a) to read: All oceanfront lots shall have a minimum setback of 60 feet from the first line of stable natural vegetation unless higher CAMA erosion rates apply.

Amend Item (b) to read:  No sanitary septic tank or no portion of a septic tank drain line shall be located closer than 50 feet from any mean high water line.

Amend item (d) to delete the following:  The floor of the main structure must not be less than nine feet from the highest point of the lot built upon. Structures in the C-2 and C-3 districts shall be exempt from this provision, as well as those built in any areas having a natural elevation of 14 feet mean sea level or above.  Add to this section the following: All structures shall comply with the Town Flood Prevention Damage Ordinance (Ch. 30 Ocean Isle Beach Code of Ordinances)

Amend Item (l) to delete:  “the town code enforcement official” and add “the Planning Director”

Amend Item (q) to delete the following:  A two-foot cantilever with a six-inch overhang will be allowed within the front and rear 25-foot setback.

Amend Item (r) to delete the following:  Amortization Schedule:  Any property owner with an accessory structure that will become nonconforming due to the adoption of the accessory structure restriction shall have a period of two years from the date of the adoption of the ordinance to remove the nonconforming structure from their property.

Amend Item (u) to add the following:  Vending machines and fully automated carwashes shall not apply to this section.

Amend Item (w) to add:  the phrase “or side yard”  when referring to the placement of allowable appurtenance structures.

  1. To add a definition of vending machine that identifies it as a machine that dispenses merchandise for

     money or electronic payment card.  Vending machines shall be an accessory structure to an existing    

     commercial establishment except in the case of a fully automated carwash.

  1. To modify Section 66-4 Definition to add the following definition:  Clubhouse (to include but not limited to BEACH CLUBS, CABANA CLUBS, PROPERTY OWNERS ASSOCIATION FACILITIES and similar type uses) means a building or facility owned or operated by an incorporated, unincorporated, chartered association or an individual or individuals nominated by such entities for the purpose of engaging in social, civic, educational, recreational, cultural or similar activities, but not primarily for profit or to render a service that is customarily carried on as a business; for the benefit of its members.  Clubhouses shall have not overnight guests.
  2. To modify Section 66-133 Number of Spaces Required to add a new section as follows:  Clubhouses – 1 space for every 80 square feet of area under roof, plus 1 space for each employee on the maximum shift.  In this same section types of uses shown as Golf courses and country clubs, recreation facilities, marinas and fishing piers will be amended to read:  Golf courses, municipally owned recreational facilities, marinas and fishing piers.
  3. To modify all sections pertaining to zoning districts to amend section for special  uses allowed, inserting

    specific criteria for clubhouses, parking, minimum lot area, width and yard requirements for the

    construction of clubhouses and to establish in each zoning chart the ability of one to construct a

    clubhouse.
